Terms and Conditions

1. Eligibility

You must be at least 13 years old, or the minimum age required in your country to use online services, to use Ghoom. If you are under the age of majority where you live, you must have permission from a parent or legal guardian.

2. Account Registration

You may create an account by providing a phone number, username, and password. During signup we verify your phone with an SMS OTP. Your phone number is stored for future login identification. After signup, you sign in with your password using your username or mobile number. You agree to provide accurate information and keep your credentials secure.

You agree to:

• Provide accurate account details
• Keep your username, profile, and contact information reasonably up to date
• Notify us promptly of unauthorized access
• Accept responsibility for activity that occurs under your account

You may not sell, rent, or transfer your account to another person.

3. Description of the Service

Ghoom provides location-based exploration features that may include:

• Maps and place discovery across listed locations
• Manual and automatic check-ins when you arrive at a place
• Track My Path route recording for your own travel sessions
• Exploration, contribution, and game scores
• Lucky Pick and related gameplay after check-ins
• Titles, badges, leaderboards, and place ownership displays
• Referrals and referral rewards
• User contributions of places and photos
• Feed, friends, events / Going To, notifications, and chat

Features may change, be limited by region or device permissions, or be discontinued as we improve the App.

4. Location Services

Ghoom uses your device location to enable check-ins, nearby discovery, map features, Track My Path, location ping history, and related gameplay. Some features require background location permission. Optional Persistent Tracking on Android may keep a low-priority notification visible so visit detection and related location features remain more reliable after the App is closed.

By using location features, you consent to location processing as described in the Privacy Policy. You may revoke permissions in device settings, but check-in, Track My Path, and related features may stop working correctly.

Ghoom does not display your live location to other users. Track My Path sessions and location ping history are private to your account. Other users may see visit-based or profile activity you make public (for example, check-in feed posts or ownership on a place), not a live GPS stream or your private path history.

You are solely responsible for your safety while traveling. Do not use Ghoom in a way that distracts you while driving or entering unsafe areas.

5. Points, Games, Badges, Titles, and Rankings

The App may award or display:

• Exploration, contribution, and game scores
• Lucky Pick outcomes
• Badges and titles
• Leaderboard rankings
• Place ownership indicators
• Referral rewards and milestones

These features are for entertainment and engagement only. Unless we expressly state otherwise in writing:

• Points and scores have no cash value
• Points cannot be redeemed for money
• Points, badges, titles, and rankings are not transferable between users
• Badges and titles are not official certifications
• Rankings, ownership, and rewards may change without notice
• Future redemption or bidding features, if any, may be modified or withdrawn

We may adjust scoring, reset progress, correct errors, or discontinue reward systems to protect fairness or the integrity of the App.

6. Anti-Fraud and Fair Play

To keep Ghoom fair, we may investigate and act on suspected abuse, including:

• Fake, spoofed, or mocked GPS locations
• Use of emulators, bots, scripts, or automated tools
• Modified, rooted, jailbroken, or tampered apps/devices used to cheat
• Creating multiple accounts for unfair advantage
• Exploiting bugs or manipulating scores, games, referrals, or leaderboards
• Sharing, selling, or farming accounts
• Interfering with App security or other users

If we detect abuse, we may remove points or rewards, reset rankings, suspend access, blacklist accounts, or permanently terminate accounts without prior notice.

7. User Content

You retain ownership of content you submit, including profile photos, place photos, location suggestions, comments, event details, and chat messages ("User Content").

By submitting User Content, you grant Ghoom a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and otherwise use that content as needed to operate, secure, improve, and promote the App.

You agree not to upload or send content that:

• Is illegal, harmful, hateful, harassing, or pornographic
• Infringes intellectual property or privacy rights
• Misrepresents places, people, or facts in a deceptive way
• Contains malware or harmful code
• Includes private homes, restricted sites, or other inappropriate location submissions

We may remove User Content or reject location/photo submissions at our discretion.

8. Community Standards

You agree not to:

• Harass, threaten, or impersonate others
• Spam, advertise, or solicit without permission
• Attempt to access another user's account or private data
• Reverse engineer the App except where permitted by applicable law
• Use the App for any unlawful purpose

9. Chat and Social Features

Chat messages and related social data are stored on our servers so conversations and history can be delivered across your devices. Do not share sensitive personal information you would not want stored or seen by recipients. We may review reports of abuse and take action consistent with these Terms.

10. Intellectual Property

The App, including its software, design, branding, logos, map presentation, game systems, and non-user content, is owned by Ghoom or its licensors. Place catalog data may include licensed or third-party sourced information.

You may not copy, modify, distribute, sell, or commercially exploit the App or its content except as allowed by these Terms or applicable law.

11. Third-Party Services

The App may rely on third-party services such as:

• Firebase Cloud Messaging and App Check
• SMS OTP delivery via Message Central
• Map rendering and geocoding providers
• Hosting, database, and content delivery infrastructure

Your use of those services may also be subject to their terms and privacy policies. We are not responsible for third-party services we do not control.

12. Availability

We aim to keep Ghoom available, but we do not guarantee uninterrupted or error-free service. Maintenance, outages, network conditions, device limitations, and permission settings may affect check-in detection and other features.

13. Suspension and Termination

We may suspend or terminate your access if:

• You violate these Terms
• We detect fraud or abuse
• Required by law
• Needed to protect users, the public, or the platform

You may stop using the App at any time.

14. Account Deletion

You may permanently delete your account from within the App. Deletion removes access to the account. We will delete or anonymize personal information — including location ping history and Track My Path sessions — except where retention is required by law or for fraud prevention, security, dispute resolution, or enforcement of our rights.

15. Disclaimer

The App is provided on an "as is" and "as available" basis.

We do not guarantee:

• Accuracy or completeness of all place information
• That every visit will be detected or scored correctly
• That Track My Path or location pings will capture every point accurately
• Continuous availability or error-free operation
• That background tracking will work on every device or OS configuration

Travel and outdoor activity are undertaken at your own risk. You are responsible for complying with local laws, safety rules, and access restrictions at places you visit.

16. Limitation of Liability

To the fullest extent permitted by law, Ghoom and its operators shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the App.

Our total liability for any claim relating to the App shall not exceed the amount you paid us, if any, to use the App during the twelve months before the claim.

17. Indemnification

You agree to indemnify and hold harmless Ghoom and its operators from claims, damages, liabilities, and expenses arising from your misuse of the App, your User Content, or your violation of these Terms.

18. Changes to These Terms

We may update these Terms from time to time. Material changes may be communicated in the App or by other reasonable means. Continued use after changes take effect constitutes acceptance of the revised Terms.

19. Governing Law

These Terms are governed by the laws of India.

Courts in India shall have jurisdiction over disputes arising out of or relating to these Terms, subject to any mandatory consumer protections that apply to you.
